Prior to the 1988 Flathead County demand to cease `occasional sales` of lots adjoining the private road, there was no subdivision, only a 1977 Covenant to maintain the private road. After 1988, any new lots sold adjoining the private road had to be part of a subdivision, i.e. with CCRs defining a homeowner's association for maintenance of the subdivision. From 1988 onwards, Rolling Meadows, River Retreat and River Retreat Condominiums subdivisions were formed.
WIth the 1988 CCRs for the Rolling Meadows subdivision, a road maintenance authority for the private road was formed with all owners of lots adjunct to the private road as members. This formalized the 1977 road maintenance covenant under which all private road adjunct lots are bound.
So you may own an `Occasional` lot parceled before 1988; but you are still a member of The Rolling Meadows Homeowner's Association for purposes of the private road authority; but your lot is `Occasional` and not a part of the Rolling Meadows subdivision.Â
